Voici l'un des événements les plus scrutés de la vie politique américaine, à l'écho souvent mondial : le choix des juges de la Cour suprême. Des millions de dollars sont dépensés. Des campagnes de presse sont orchestrées. Des films polémiques sont diffusés. Des scandales sont révélés.. Comment une procédure apparemment si aride en est-elle venue à susciter de telles passions collectives ? En restituant sur la longue durée les batailles acharnées qui entourent nombre de nominations, Julien Jeanneney le donne à comprendre. Aujourd'hui comme hier, les enjeux affrontés par ces juges sont fondamentaux : répartition des pouvoirs dans la fédération, abolition de l'esclavage, lutte contre les monopoles, New Deal, déségrégation, interruption volontaire de grossesse, port des armes, participation électorale.... Au fil de ces recrutements, le destin du pays se dessine et cette institution prend une autre couleur, loin de la figure abstraite d'une instance impartiale appliquant, tel un automate, une Constitution qui aurait réponse à tout. Ainsi se trouvent incarnés les hommes et femmes dont la désignation et ses conséquences ont contribué à forger les États-Unis d'Amérique, et continuent de le faire..
